Terms of Service & Waiver

Please read these Terms of Service carefully, as they contain important information regarding your legal rights, remedies, and obligations. In using this website to receive information about Lift Cycle, book classes, cancel, and pay for services, you are deemed to have read and agreed to the following Terms of Service.

RULES, REGULATIONS, SCHEDULES; TERMS AND CONDITIONS

Member agrees to abide by all rules, regulations, schedules and terms and conditions of LIFT Cycle, which may be posted at any "LIFT Cycle" branded studio or website, or issued orally from LIFT Cycle, and which may be amended from time to time, at management's sole discretion.

RESERVATIONS

In order to place a reservation, customers must first create an account on our website or app, then purchase rides or an Unlimited membership.  Accounts cannot be shared, and each client must create their own account. Your credit or debit card will be charged in the amount of your order when you submit your reservation. LIFT Cycle accepts Visa, MasterCard, American Express, and cash at the studio. All reservations will be made using the LIFT Cycle website or in the studio. Please arrive to your class on time and check in at the front desk upon arrival. Do not assume the front desk staff knows you have arrived. If you do not check in, we may release your bike and you may be marked as a No Show. Checking in for other clients or under a different name is prohibited.

FEES

You acknowledge that LIFT Cycle charges fees for its services, and LIFT Cycle reserves the right to change its fees from time to time in its discretion. Unlimited Memberships will remain the rate that was in effect at the time of initial purchase of that membership.  If there is a break in membership, any new membership purchased will be subject to the new rate. If LIFT Cycle terminates your membership because you have breached these Terms of Service, you may not be entitled to a refund of any unused portion of membership or other fees.

CANCELLATION POLICY

To cancel a Lift Cycle class you reserved using a class credit, you may do so without penalty by canceling online NO LATER THAN 12 hours before your scheduled class. If your bike is canceled by this time, your class credit will be returned to your account. If you cancel your bike within 12 hours of the start time of your class, the class will be forfeited.

To cancel a Lift Cycle class you reserved using an unlimited membership, you may do so without penalty by canceling online NO LATER THAN 12 hours before the start time of your scheduled class. If you cancel your bike within 12 hours of the start time of your class, you will be charged a $15 late cancel fee. If you do not have a working card on file, your account will be temporarily frozen until you update the card on file, at which time the late cancel fee will be charged, and your account will be reinstated.

Cancellations via electronic mail (email), Facebook Messenger, Instagram, phone call, or text message will not be taken, and you will be charged.

NO-SHOW POLICY

Should you no-show to a LIFT Cycle class you reserved using a class credit, the class will be forfeited.

Should you no-show to a LIFT Cycle class you reserved using an unlimited membership, you will be charged a $21 no-show fee. If you do not have a working card on file, your account will be temporarily frozen until you update the card on file, at which time the no show fee will be charged, and your account will be reinstated.

Please be aware that we release bikes EXACTLY two minutes before the start of class to those on the waitlist. If you are running late, please call the studio and speak with a front desk staff member to ensure we hold your bike.

WAITLIST POLICY

If you book multiple classes or waitlist multiple classes, you are solely responsible for canceling your classes within the bounds of the cancellation policy. LIFT Cycle staff cannot be held responsible for accidental bookings by clients or double bookings or double waitlisted classes made by clients. Late cancel and no-show fees apply if you do not cancel within the bounds of the cancellation policy.

The system will auto-populate clients into class from the waitlist as other clients with confirmed spots cancel, and bikes will be assigned as such up until 1 hour before the start time of the class. At that time, the waitlist will be closed and open bikes will be filled by first come. 

LIFT Cycle staff will add walk-in, waitlisted clients in the order in which they were added to the waitlist by the computer system, top to bottom, up until 1 hour before the start of class. After that, waitlist will be closed and open bikes will be filled on a first come, first served order online or in the studio.

EXPIRATION POLICY

All expiration dates/terms are clearly noted on the purchase page. No exceptions will be made to the expiration date/term.

RETURN POLICY

Series Returns: All series sales are final. No refunds for cash or credit will be provided after the purchase of a series.

Unlimited Membership Returns: Sales of Unlimited Memberships are final, except as provided in the terms of any Unlimited Membership Contract.

Merchandise Returns: All merchandise sales are final. Exchanges are allowed for same item within 30 days of the date of purchase. Clothing must be in original condition, unworn and unwashed with ALL original tags attached. Clothing with marks from makeup or deodorant will not be exchanged. LIFT Cycle staff has the sole discretion in authorizing exchanges.

RETURN PAYMENT PENALTY

Customer will automatically be charged any bank fee imposed to the studio, plus a processing fee of up to $20 for any returned payment item due to closed account, insufficient funds, or similar issue. If this occurs, Lift Cycle retains the right to collect the current and past due balances in any subsequent month. Memberships of Class credits will be frozen until all fees are paid.

VALUABLES AND PERSONAL PROPERTY

Customers are urged to avoid bringing valuables into the facilities and that Lift Cycle shall not be liable for the loss of, theft of, or damage to my personal property, including items left in  bathrooms, changing rooms, studio, or anywhere else in the facilities.


ASSUMPTION OF RISK, WAIVER, AND RELEASE 

By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment, or any other location or venue where LIFT Cycle is providing services (individually and/or collectively, the "Classes and Facilities") of LIFT Cycle Studio LLC. and its subsidiaries (collectively, "LIFT Cycle"), I hereby acknowledge on behalf of myself, my heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in indoor cycling and exercise equipment in association with the Classes and Facilities. I acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. I also acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death.  An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By visiting Lift Cycle, you voluntarily assume all risks related to exposure to COVID-19.   At all times, I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to me by staff. If in the subjective opinion of the LIFT Cycle staff, I would be at physical risk participating in LIFT Cycle's Classes, I understand and agree that I may be denied access to the Classes and Facilities until I furnish LIFT Cycle with an opinion letter from my medical doctor, at my sole cost and expense, specifically addressing LIFT Cycle's concerns and stating that LIFT Cycle's concerns are unfounded. In consideration of being allowed to participate in and access the Classes and Facilities, I hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by me in relation to the Classes and Facilities, (2) release, indemnify, and hold harmless LIFT Cycle, its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Classes or use of the Facilities, and (3) represent that I (a) have no medical or physical condition that would prevent me from properly using any of LIFT Cycle's Classes and Facilities, (b) do not have a physical or mental condition that would put me in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. I acknowledge that if I have any chronic disabilities or conditions, I am at risk in using LIFT Cycle's Classes and Facilities, and should not be participating in any Classes. 

I have read this Assumption of Risk, Waiver, and Release Agreement, fully understand its terms, and understand that I am giving up substantial rights including my right to sue LIFT Cycle under certain circumstances. I acknowledge that I am signing this waiver freely and voluntarily. The term of this waiver is indefinite. 

 VALUABLES AND PERSONAL PROPERTY

I acknowledge that I have been urged to avoid bringing valuables onto the Facilities and that LIFT Cycle shall not be liable for the loss of, theft of, or damage to my personal property, including items left in lockers, bathrooms, studios, or anywhere else in the Facilities. I acknowledge that no portion of any fees paid by me is in consideration for the safeguarding of valuables. 

ETIQUETTE

To preserve the LIFT Cycle philosophy and life style, I agree to abide by LIFT Cycle's etiquette guidelines found on LIFT Cycle studio walls and on LIFT Cycle's website (www.liftcyclestudio.com). LIFT Cycle reserves the right to deny access to any person LIFT Cycle deems to be acting in an inappropriate or unsafe manner. 

IN THE SPIN ROOM DURING CLASS

No cell phones, and watches on theater or dark mode.

Keep the floor clean - place all belongings in a cubby to keep the floors and aisleways clear.

No chit chat - your neighbor is in their zone.

An additional Assumption of Risk, Waiver and Release form for minors(riders under 18 years old) must be signed by the guardian in the studio. 

ENTIRE AGREEMENT

Except for the rules, regulations, policies, schedules and terms and conditions posted at "LIFT Cycle" branded studios or website or issued orally by LIFT Cycle from time to time at its discretion, all of which are incorporated into this contract, and any health or other waivers provided by you to LIFT Cycle, this contract constitutes the entire and exclusive agreement between the parties relating to the subject matter hereto and supersedes any oral or other written understanding. This contract only may be modified in writing and executed by a duly-authorized representative of LIFT Cycle. Employees are not authorized to make any independent agreements with any LIFT Cycle member or customer.
